1. General terms & conditions

 

Article 1 - Introduction

For the readability of the document, the "I" form was chosen. Where "I" or "my" is stated, the Understand Children Better / Neiki company is meant. Understand Children Better is part of Kinderen Beter Begrijpen BV.

Article 2 - Conditions for services and products

2.1 In my offline training, online training and ebooks I share my knowledge, experience and tools to Understand Children Better. The success of these training courses largely depends on your own efforts.

2.2 You can cancel appointments up to 24 hours in advance and then you can schedule a new appointment in consultation. If the call is canceled later than 24 hours in advance, the appointment is canceled and cannot be made up.

 

Article 3 - Money Back Guarantee and / or Trial Period

3.1 I think it is important that my participants are satisfied, which is why I have a "money back guarantee". You can cancel your participation free of charge up to 14 (fourteen) days after purchasing a service or product. You can cancel by sending an email to support@evelineruitenberg.com.

If you have already made payments, I will refund your money as soon as possible. You do have to hand in all course material received or remove it from your computer and any licenses on the services and products provided by me will expire.

3.2 After the 14 (fourteen) day period it is no longer possible to cancel participation in the program and you have to pay the full participation fee. You explicitly agree that article 7: 408 paragraph 1 of the Dutch Civil Code does not apply and that premature termination is not possible.

 

Article 4 - Prices and payment

4.1 The prices of my services and products are on the website. These prices are always excluding VAT.

4.2 Payment can be made in one go or in installments. If you pay for a service or product in installments, then the obligation to pay remains even after completion of this service or product.

4.3 If you fall behind with payments, I reserve the right to cancel an agreement and suspend my obligations until you have paid the relevant period (s).

4.4 Offers, prices or quotes are always without obligation and do not automatically apply to future services, products or quotes.

 

Article 5 - Intellectual property / Use of materials.

5.1 I own the intellectual property rights to the texts, materials of the training courses (offline and online training courses) and products. It is not permitted to share this with third parties, unless I have given written permission for this.

5.2 It is also not allowed to sell the acquired knowledge commercially or to include it in your own product or training, unless I have given written permission for this.

 

Article 6 - Materials and licenses

6.1 I strive to keep the materials accessible to my participants online for life, but I cannot guarantee this. If I am going to remove the materials or move to a different URL, I will always let you know by e-mail 3 (three) months in advance, so that you are able to download or save it in another way. I will always send this message to the last e-mail address that you have made known to me. Not passing on a new e-mail address is at your risk.

 

Article 7 - Complaints

7.1 If you are dissatisfied with a service or product, a part thereof or the support from me, please let me know as soon as possible by sending me an email. I will then receive a description of the complaint that is as clear as possible, so that I am able to respond and if the complaint is justified in correcting it. I cannot handle a complaint that is not clearly defined.

7.2 You must report any complaints to me within 14 days of purchasing a product or service. If you report the complaint later, you are no longer entitled to repair, replacement or compensation.

7.3 Even if you send a complaint, your obligation to pay remains.

 

Article 8 - Liability

8.1 Subject to intent or deliberate recklessness, my total liability for an attributable shortcoming in the performance of the agreement or for any other reason is limited to compensation for direct damage to a maximum of the amount stipulated for that agreement, excluding VAT.

8.2 The liability for indirect damage, such as; consequential damage, lost profit, missed savings, reduced goodwill, damage due to business interruption, etc., is excluded.

8.3 In the event of a culpable shortcoming, you must first give me written notice of default, with a reasonable period of time, so that I am able to meet my obligations, or to correct any errors, or to limit damage, or to eliminate it.

 

Article 9 - Privacy

9.1 I take the privacy of my participants seriously and I only use your personal data in the context of my services. I adhere to the legal rules regarding the protection of personal data. More information about which data I process and for what purpose can be found in my Privacy statement.

 

Article 10 - Other

10.1 Deviations from these General Terms and Conditions only apply if they have been agreed in writing between me and you.

10.2 If one or more provisions in these General Terms and Conditions are wholly or partially invalid or should be annulled, the remaining provisions in these General Terms and Conditions remain fully applicable. We will then consult with each other to agree on new provisions, taking into account as far as possible the purpose and scope of the original provisions.

10.3 In writing is also understood by e-mail.

 

Article 11 - Disputes

11.1 In the event of any disputes, we will always do our best first to resolve the dispute between ourselves, before we submit a dispute to the court.

11.2 If we cannot reach a mutual agreement, we will submit disputes to the court in Arnhem.

 

Article 12 - Applicable law

12.1 This agreement is governed by Dutch law.

 

Article 13 Amendment of the conditions

13.1 I am authorized to make changes to these terms and conditions. These changes take effect at the announced time.

13.2 I will send the amended conditions to you by e-mail in a timely manner. If no time is specified, the changes will take effect for you as soon as you have received the change.

2. Privacy Statement & Cookie Policy

 

Thank you for your confidence in us. We see it as our responsibility to protect your privacy. On this page we will tell you what information we collect when you use our website, why we collect it and how we use it to improve your user experience.


This privacy policy applies to the services of Kinderen Beter Begrijpen (NEIKI) aka Understand Children Better. Understand Children Better is not responsible for the privacy policies of other sites and sources. By using this website you indicate that you accept the privacy policy. Understand Children Beter respects the privacy of all users of its site and ensures that the personal information you provide is treated confidentially.


Processing of personal data by Understand Children Better

Understand Children Better may process personal data about you because you (either personally or through a company) order services and/or products from Understand Children Bettter and/or because you provide this data yourself. Understand Children Better may process the following personal data:

  • Contact details: Understand Children Better uses your name, company and contact information, such as address, telephone number and email address, to communicate with you about the implementation of the agreed services and delivery of products. If you have given your explicit permission, Understand Children Better will add your contact details to the list of subscribers to the Understand Children Better newsletter. The newsletter contains relevant articles, information about Understand Children Better's services and/or products and related issues. Each newsletter contains a link that allows you to unsubscribe. The newsletter subscriber database is not provided to third parties.
  • Visitor data: on the website of Understand Children Better (hereinafter referred to as: the Website) visiting data, including your IP address, is recorded. See the Cookie section of this document for more information about the use of personal data on the Website. 
  • Payment data: Understand Children Better uses your payment information, such as bank account number and possibly credit card information, to process payments in the context of a contract.

Sharing with third parties

Understand Children Better can share personal information with third parties for the following purposes: 

  • Service providers: Understand Children Better shares the personal data with the engaged service providers to be able to perform their work for Kinderen Beter Begrijpen correctly and efficiently. These companies may be located in the Netherlands, in Europe but also outside Europe. Understand Children Better will enter into a processing agreement with companies who process your data to ensure the same level of security and confidentiality of your data. Understand Children Better will remain responsible for this processing. Finally, Understand Children Better provides your personal data to other third parties, only after your explicit consent.
  • Government agencies: At the request of government agencies, Understand Children Better will provide the personal data, if this is required by relevant laws and regulations.

Understand Children Better makes use of various types of cookies when offering services and products on the website. Understand Children Better has no influence on this. Understand Children Better has not given Google permission to use the information obtained via Understand Children Better for other Google services.
Google states it adheres to the Privacy Shield principles and is affiliated with the Privacy Shield program of the United States Department of Commerce. This program means that an adequate level of protection for the processing of any personal data is ensured by Google.

  • Finally, the website uses cookies from social networks, such as LinkedIn, Facebook and Twitter. The latter cookies apply only if you use the service in question and make it possible to link or tweet messages.

The website may display links to external websites and organizations. Understand Children Better is not responsible for the use of your data by these organizations. Please read the privacy statement of the website you visit.

 

Storage period for personal data

Understand Children Better does not keep your personal data longer than necessary to realize the goals for which Understand Children Better processes your personal data and to comply with legal obligations.


On the basis of tax laws, certain information about clients, such as quotations and invoices, must be kept for 7 years. Other information will be kept after one (1) year or one (1) year after the end of the agreement. 

 

After the retention period Understand Children Better destroys your personal data.

 

Reviewing, modifying or deleting personal data

You have the right to view, correct or remove your personal data. You can send a request for inspection, correction or deletion to support@evelineruitenberg.com. Understand Children Better will respond to your request in writing as soon as possible, but within four weeks.

 

Security

Understand Children Better takes the protection of your personal data seriously and takes appropriate measures to prevent abuse, loss, unauthorized access, unwanted disclosure and unauthorized changes. Understand Children Better has security procedures in place to prevent unauthorized access to this data or loss of personal data.
